Listing Agent or Independent Contractor?
Not every home seller needs a full-service real estate agent. Some just need help with certain tasks, like listing their home online, taking photos, or handling paperwork. That’s where the Independent Contractor Listing Agreement comes in. This special agreement allows sellers to hire a real estate professional for specific services without entering into a full agent-client relationship.
For 2025, this agreement has been updated to make things clearer and more flexible. One of the biggest changes is how fees are handled. Instead of choosing from a set pricing structure, sellers and contractors can now write in whatever arrangement works best for them. This allows for more straightforward negotiations without unnecessary complications.
Another major update is the removal of agency relationship explanations. The old form included a section about different types of agency, which didn’t really apply since independent contractors aren’t acting as agents. That section was removed to eliminate confusion and keep the focus on what really matters—the services being provided.
The way services are listed has also changed. Previously, the form had check boxes for different tasks, limiting options to a preset list. Now, there’s simply a blank space where sellers and contractors can clearly outline the exact services being agreed upon. This allows for more customized agreements tailored to each seller’s needs.
Keep in mind, not every REALTOR or Agent will work in this "contractor" capacity, however assuming they do, these updates make it easier for sellers to get the specific help they need without extra complications.
